The Failure of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the announcement of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The chain of opposing developments captured the harsh reality of the recent timeframe. By day, negotiation efforts are waged: positive announcements are issued from various governments. Significant resources is devoted on restraining certain initiatives. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "resolution".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is able to track projectile deployments from across the border, a ability afforded by timely intelligence. From vantage locations, Ukrainian air force fighter jets that had been deployed to intercept incoming cruise missiles flew past – modern combat jets delivered to Ukraine by NATO members.

Shortly after, Kyiv's missile defense engaged: several firings deployed against a incoming threat. This was a sophisticated defense system at work, probably provided by allied countries. Every launch shakes the surroundings, causing tremors. The moment of terror quickly becomes sober acceptance: maybe the incoming missile won't strike its target this time, preventing destruction from catastrophe and further power outages.

Persistent Threats

Following this, a automatic firearm opened up on a drone in the vicinity, part of a defensive team – almost certainly allied-provided weaponry. Regrettably, the shots failed to hit the enemy aircraft – it maintained course toward its objective.

With pauses, this carried on until dawn. Kyiv awoke to the early updates: seven people killed, devastation and heating outages in numerous residences as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – enduring hostilities. But those 24 hours encapsulated Ukraine's vital need on Western support – a need that European nations are evidently unprepared to fill in the short term.

Ineffective Peace Efforts

The detailed framework from Washington generated strong feelings, debate and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and multilateral gatherings.

Every new proposal from US leadership unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This trend will, certainly, persist.

Strategic Calculations

It is convenient to criticize certain parties of consistently pushing Russian terms. But that does not seem to be the complete picture. Washington works based on a principle well known to seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The White House believes that it is unfeasible to force Russia to abandon the territory that it presently holds in Ukraine's south or east.

The problem is that while accepting these circumstances, US leadership does minimal to prevent Kremlin actions, through statements or actions, from thinking that the situation will not shift further in its benefit in the near future.

Conflicting Perspectives

Therefore, Russian leadership is convinced that duration works to their advantage – that Ukraine and its supporters are nearing depletion. Their motivation to agree to terms that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to achieve ceasefire, but they will carry on as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing lives and land but avoiding a complete military breakdown until conditions improve in its benefit.

Present Conditions

Objectively, there are no real preconditions for a truce. Now, subjective factors are coming into play: personal goals to negotiate peace and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unsuitable, so that their priority does not shift toward internal issues. And although their task will now be significantly challenging after recent developments, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are influencing discussions.

Summary and Prospects

It took a mere seven days to eliminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by Washington, resistance by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, recent disclosures, all did their job.

While new proposals based on established approaches are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are based on Russian demands and demonstrate particular unwillingness to alter the situation, if they stand together and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, primarily depend on ongoing international assistance.
